These Terms and Conditions ("Terms") govern your use of the Shopify application ("the App") provided by 8Kilo ApS ("we," "us," or "our"), a company based in Denmark. The App provides product metafield editing and image analysis services ("the Service") to merchants using Shopify stores.

By installing or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

Service Description

Our App provides the following services:

• Linking Products: Automated linking of products. We don't alter any existing product data in this process.
• Image Analysis: Automated analysis of product images to show swatches. We don't alter any existing product data in this process.
  Data Processing: Real-time processing of product information to support app functionality

The Service is provided "as is" and we reserve the right to modify, update, or discontinue features at any time with reasonable notice.

User Responsibilities

As a user of our App, you agree to:

• Compliance: Use the App in compliance with all applicable laws, regulations, and Shopify's Terms of Service
• Account Security: Maintain the security of your Shopify account and notify us immediately of any unauthorized access
• Data Accuracy: Ensure that any data you provide through the App is accurate and up-to-date
• Proper Usage: Use the App only for its intended purposes and not attempt to reverse engineer, modify, or circumvent its functionality
• Backup Responsibility: Maintain regular backups of your store data, as you are solely responsible for data recovery

Limitations of Liability

IMPORTANT: Please read this section carefully as it limits our liability to you.

• No Revenue Guarantees: We make no guarantees regarding sales, revenue, or business performance. You acknowledge that we are not responsible for any lost revenue, profits, or business opportunities
• Service Interruptions: We are not liable for any damages, losses, or business interruptions caused by app downtime, maintenance, or technical issues
• Data Loss: While we implement security measures, we are not responsible for any data loss or corruption. You are responsible for maintaining your own backups
• Third-Party Integration: We are not responsible for issues arising from Shopify platform changes, third-party integrations, or external services
• Maximum Liability: Our total liability to you for any claims related to the App shall not exceed the amount you have paid us in the 12 months preceding the claim

Disclaimers

• No Warranties: The App is provided "as is" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement
• Performance: We do not guarantee that the App will be error-free, uninterrupted, or meet your specific requirements
• Compatibility: We do not guarantee compatibility with all Shopify themes, apps, or customizations
• Results: We make no representations about the results you may achieve through use of our App

Service Availability

• Uptime: While we strive for high availability, we do not guarantee 100% uptime and are not liable for any downtime
• Maintenance: We may perform scheduled or emergency maintenance that may temporarily interrupt service
• Force Majeure: We are not responsible for service interruptions caused by events beyond our control, including but not limited to natural disasters, internet outages, or third-party service failures

Intellectual Property

• App Ownership: We retain all rights, title, and interest in the App, including all intellectual property rights
• User Data: You retain ownership of your store data and content. We do not claim ownership of your data
• License: We grant you a limited, non-exclusive, non-transferable license to use the App in accordance with these Terms
• Restrictions: You may not copy, modify, distribute, or create derivative works based on our App

Privacy and Data Protection

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our App, you also agree to our Privacy Policy.

Indemnification

You agree to indemnify, defend, and hold harmless 8Kilo ApS, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content or data you provide through the App

Termination

• Your Right to Terminate: You may stop using the App at any time by uninstalling it from your Shopify store
• Our Right to Terminate: We may suspend or terminate your access to the App if you violate these Terms or for any other reason with reasonable notice
• Effect of Termination: Upon termination, your right to use the App will cease immediately. Provisions that should survive termination will remain in effect
• Data Retention: Following termination, we may retain your data in accordance with our Privacy Policy and applicable laws

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or other appropriate means. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

Governing Law and Disputes

• Governing Law: These Terms are governed by the laws of Denmark
• Jurisdiction: Any disputes arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of Danish courts
• Limitation Period: Any claims must be brought within one year of the date the cause of action arose

Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 8Kilo ApS regarding the App and supersede all prior agreements and understandings.
